The government will pick the fall guys (and/or fall gals). I think state governments can still pass legislation declaring it to be terrorism. The DoD does not have the moral authority to damage the ecosystem and poison its citizens. It is subject to Congressional oversight at a minimum. I would call intentionally contaminating and/or poisoning the food supply both terrorism and more importantly treason. There is no statute of limitations for treason.
